1. Introduction and Scope

FameBoosta (“Company,” “we,” “us,” or “our”) is committed to the protection of the privacy and personal information of individuals who access, browse, or otherwise interact with the website located at www.fameboosta.com (the “Site”) and any associated services offered thereon (collectively, the “Services”). This Privacy Policy (“Policy”) sets forth, in accordance with applicable data protection legislation, the categories of information collected by the Company, the purposes and legal bases for such collection, the manner in which such information may be disclosed to third parties, and the rights available to individuals (“you” or “User”) with respect to such information. By accessing or using the Services, you acknowledge that you have read and understood the terms of this Policy.

2. Categories of Information Collected

2.1. Personal Information. In connection with your use of the Services, the Company may collect the following categories of personal information: (a) full legal name; (b) email address; (c) billing address; (d) social media username (e) telephone number, collected solely to the extent necessary to fulfill an order placed through the Services; and (f) payment related details, which are collected and processed exclusively via secure, PCI DSS-compliant third-party payment processors.

2.2. Limitation on Payment Data. For the avoidance of doubt, the Company does not collect, store, retain, or otherwise have access to the full payment details of any User, including but not limited to complete credit or debit card numbers or associated security codes. Notwithstanding the foregoing, the Company may receive certain limited transaction related information including, without limitation, payment confirmation data, transaction reference numbers, and order particulars as reasonably necessary to effectuate fulfillment of a User’s purchase.

3. Purposes of Processing

The Company processes the categories of personal information described in Section 2 for the following purposes: (a) the processing and fulfillment of orders submitted through the Services; (b) communication with Users regarding purchases, inquiries, or support-related matters; (c) the improvement, maintenance, and optimization of the Site and Services; (d) the transmission of promotional communications, where the User has provided affirmative opt-in consent; and (e) the detection, investigation, and prevention of fraudulent or otherwise unauthorized activity, and the maintenance of the security and integrity of the Services.

4. Disclosure of Information to Third Parties

4.1. The Company does not, and will not, sell personal information to any third party.

4.2. Notwithstanding the foregoing, the Company may disclose personal information to the following categories of recipients: (a) Trusted Third-Party Service Providers, including without limitation payment processors engaged by the Company (including, where applicable, Fygaro or any successor payment service provider), hosting providers, and analytics providers, each of whom is contractually bound to maintain the confidentiality and security of such information; and (b) Governmental or Legal Authorities, where such disclosure is reasonably necessary to comply with applicable legal obligations, regulatory requirements, or to protect the rights, property, or safety of the Company, its Users, or third parties.

5. Rights of Data Subjects

5.1. Subject to the User’s jurisdiction of residence, and to the extent provided under applicable law, Users may be entitled to exercise the following rights with respect to their personal information: (a) the right to request confirmation of, and access to, personal information held by the Company; (b) the right to request rectification of inaccurate or incomplete personal information; (c) the right to request erasure of personal information, subject to any applicable legal or contractual retention obligations; (d) the right to receive a copy of personal information in a structured, commonly used, and machine-readable format; (e) the right to opt out of the sale or sharing of personal information, it being noted that the Company does not engage in such sale; and (f) the right to withdraw previously granted consent to marketing communications at any time, without affecting the lawfulness of processing conducted prior to such withdrawal.

6. Marketing Communications

Where the User has furnished affirmative consent, the Company may utilize the User’s name, email address, and/or telephone number for purposes of transmitting promotional messages, special offers, service-related updates, and other content deemed of potential interest to the User. The Company may further, from time to time, solicit feedback for purposes of market research and service enhancement. Users retain the unilateral right, at any time, to withdraw consent to receipt of such communications by way of the unsubscribe mechanism embedded within any marketing communication, by modification of account-level preferences, or by direct communication with the Company via the contact particulars set forth in Section 12.

7. Data Security

The Company has implemented, and shall maintain, administrative, technical, and physical safeguards reasonably designed to protect personal information against unauthorized access, use, disclosure, alteration, or destruction, including without limitation SSL encryption, access control mechanisms, and secure authentication protocols. The Company further relies upon third-party service providers who maintain comparable security measures with respect to information processed on their respective platforms. Access to personal information is restricted to personnel for whom such access is reasonably necessary in the performance of their duties, and who are subject to obligations of confidentiality.

Notwithstanding the foregoing, no method of electronic transmission or storage can be guaranteed to be entirely secure, and the Company cannot warrant absolute security. In the event of a security incident affecting personal information, the Company shall undertake a prompt investigation and shall notify affected individuals and relevant regulatory authorities within such timeframes as may be prescribed under applicable law.

8. Payment Security

All transactions conducted through the Services are processed via a third-party payment gateway provider operating independently of the Company. The Company does not store, process, or otherwise have access to the full credit or debit card information of any User; such information is transmitted directly to, and processed exclusively within, the secure infrastructure of the applicable third-party payment provider. Such provider employs security measures designed to safeguard cardholder data, including PCI DSS-compliant processing standards, SSL encryption, tokenization of sensitive payment information, and 3D Secure authentication.

9. Data Retention

Personal information is retained by the Company only for such duration as is reasonably necessary to fulfill the purposes set forth in this Policy, specifically: (a) information pertaining to orders and transactions shall be retained for the period required under applicable tax, accounting, and consumer protection legislation; (b) account-level information shall be retained for the duration that the User’s account remains active, and for a reasonable period thereafter to accommodate potential reactivation; and (c) information collected for marketing purposes shall be retained until such time as the User withdraws consent or unsubscribes. Where a longer retention period is mandated or permitted under applicable law including, without limitation, for purposes of dispute resolution or regulatory compliance the Company shall retain such information for the duration so required, following which it shall be securely deleted or rendered anonymous.

10. Minors

The Company does not knowingly solicit or collect personal information from individuals who have not attained the age of majority in their jurisdiction of residence. Where a parent or legal guardian has reason to believe that a minor has submitted personal information to the Company absent appropriate consent, such parent or guardian is invited to contact the Company pursuant to Section 12, whereupon the Company shall take commercially reasonable steps to promptly remove such information.

11. International Transfers

Where a User accesses the Services from a jurisdiction other than that in which the Company principally operates, such User’s personal information may be transferred to, processed in countries where the Company or its service providers operate, which may have data protection laws that differ from those in the User’s jurisdiction.

14. Limitation of Liability

While the Company undertakes reasonable administrative, technical, and physical measures to protect the personal information of Users, no method of electronic transmission or storage can be guaranteed to be wholly secure, and the Company cannot guarantee absolute security despite implementing reasonable safeguards. In the event of a security incident, the Company shall undertake such investigative, remedial, and notification measures as are required under applicable law, without prejudice to any rights available to affected Users under applicable consumer protection legislation.
